Terms and Conditions of Participation in fabidoo Contests
Contest „Best Fabidoo of the week“
fabidoo Gmbh (in the following „fabidoo“) occasionally organizes online contests. Participation in these contests is subject to our Terms and Conditions of Participation (in the following “TCP”).
1. Data Protection and Privacy Statement
By participating in the contests the participant explicitly agrees to fabidoo storing the required data for the duration of the contest and beyond. At any time the participant is free to suspend the agreement by means of revocation, thus canceling participation. fabidoo points out that no personal data of the participant whatsoever will be made accessible to a third party.
2. Participation
Each contest has its own fixed time-frame (voting period) and takes place on the website www.fabidoo.com. The object of the game is to shape the best fabidoo of and within the voting period. A registration is required for participation. In addition, the shaped fabidoo must also compete on the „voting gallery” of the current contest. Each fabidoo may only compete in a contest once. Participants must register prior to registration deadline. The most popular fabidoo is determined by ballot procedure (user voting). After the voting period deadline the shaper of the highest-scoring fabidoo will be proclaimed winner. Each participant is entitled to one prize only. Payments in cash or transferrals of prize to others are excluded. If the handover of the prize is not possible or otherwise deemed unreasonable, the winner will receive a compensation of equal value. Winners will be notified by fabidoo via email. In case the winner fails to answer the notice within 21 days, the claim to the prize expires and the participant ranking second place of the contest in question wins. The participant is responsible for the correctness of the submitted address. No responsibility is taken for the disclosure of the winners.
3. Participants, Disqualification from Contest
To be eligible to enter the contest persons must be at least 18 years old or at least 14 years old with effective approval of legal guardian. Participation in the contest absolutely requires the correctness of all submitted personal data. Employees of fabidoo, affiliated companies and contest partner enterprises as well as family members of the above mentioned are excluded from participation. fabidoo reserves the right to exclude persons from the participation if there are justifying reasons - e.g. violation of TCP, undue interference regarding the contest, manipulation, multiple votings by individuals etc. – for such action. As the case may be, prizes can afterwards be denied and reclaimed.
4. Change of Participation Rules and Termination of Contest
fabidoo reserves the right to change the participation rules at any time. Furthermore, fabidoo reserves the right to terminate or adjourn the contest or to choose a winner owing to significant reasons and without notice. This is especially applicable for reasons apt to disrupt or prevent the intended proceedings of the contest. If such a termination is caused by a participant’s behaviour, fabidoo is entitled to compensation by the participant for the damage inflicted.
5. Limitation of Liability
fabidoo - on whatever legal grounds - can only be held liable if the damage was caused by the breach of a significant contractual obligation („cardinal obligation“) in a manner endangering the aims of the contract or if the damage can be attributed to malicious intent or gross negligence. Technical defects or environmental impacts not predictable are explicitly exempt from liability. Liability for the injury of life, body and health due to fabidoo remains effective; this is also applicable in regard to the statutory Product Liability Act.
6. Miscellaneous
If several provisions of the TCP are or become completely or partially invalid, the TCP’s general validity will not be affected. An appropriate regulation which best corresponds to the purpose of the invalid or incomplete provision will be employed in its place.
